McPherson’s Limited Faces Federal Court Ruling in ASIC Proceedings

ASX-listed health and beauty products supplier acknowledges judgment and prepares for penalty determination, projecting a $2 million provision.

McPherson’s Limited (ASX: MCP), a supplier of some of Australia’s well-known essential health and beauty products, has announced that the Federal Court of Australia has ruled in favour of the Australian Securities & Investments Commission (ASIC) in proceedings against the company and a former Chief Executive Officer and Managing Director. The company’s portfolio is anchored in iconic household brands such as ‘Manicare’, ‘Swisspers’, and ‘Dr. LeWinn’s’. This ruling, handed down on 13 August 2026, follows McPherson’s earlier announcement on 16 October 2024 regarding the commencement of these proceedings.

McPherson’s Limited acknowledges the Court’s decision and stated it is carefully considering the judgment. The company confirmed that, subject to any available appeal rights, a further hearing will be held to determine any penalties to be imposed, noting that no orders have yet been made. The proceedings relate to events that occurred in 2020, and since that time, McPherson’s has undergone substantial renewal at both Board and management levels, with the Board and management remaining committed to maintaining strong governance practices and robust disclosure processes.

As a direct result of the Court’s decision and in accordance with Australian Accounting Standards, McPherson’s expects to recognise a provision of $2 million in its FY26 financial statements. This amount represents the company’s best estimate of the potential penalties that may be imposed by the Court. However, the company also cautioned that the actual amount of any penalties payable will ultimately be determined by the Court at a future date and could be materially higher or lower than this provision. McPherson’s Limited anticipates announcing its full year results for the period ending 30 June 2026 on Thursday, 27 August 2026.
